IMMIGRATION TRAVEL GUIDE · REVIEWED OCTOBER 29, 2026
International Travel With a Pending Immigration Case
Check before you book.
Advance parole approval does not resolve every immigration risk. A review of your documents and immigration history can help you understand the questions to address before committing to international travel.
Travel approval is not a guarantee of return or immigration approval.

Plan with your immigration case in mind
November and December travel plans are a reason to review your records early. This is a seasonal guide, not an announcement of a new rule today. Keep travel permission, permission to work and immigration status separate: the documents serve different purposes.
On August 13, 2026, the Board of Immigration Appeals issued Matter of Delcarmen-Lara, 29 I&N Dec. 830, overruling earlier precedent on advance-parole departures under the unlawful-presence provision at issue. The Board applied its holding prospectively. Prior unlawful presence can create serious issues even when a person has a travel document. Whether a bar, exception or waiver applies requires individual review; this guide does not calculate anyone’s unlawful presence.
Questions before international travel
Can I travel while my Form I-485 is pending?
A pending green-card application is not travel permission. In general, leaving without first obtaining appropriate advance parole can result in the application being treated as abandoned; narrow exceptions apply to certain categories. Even with the appropriate document, admissibility and other risks require separate review.
Does approved advance parole guarantee that I can return?
No. A travel document allows a person to seek the applicable entry or parole process; it does not guarantee the border decision or approval of a pending benefit. The August 2026 decision also makes prior unlawful-presence history an important part of a pre-travel review.
Is my work permit or I-131 receipt enough for travel?
Do not assume so. A receipt acknowledges a filing and is not an approval. A work permit by itself does not establish travel authorization. Some cards have combined functions; the exact wording, category and validity dates must be checked.
Are advance parole, TPS travel authorization and a refugee travel document the same?
No. Form I-131 covers several document types, including advance parole, TPS travel authorization, refugee travel documents and reentry permits. Different eligibility and travel rules apply. A rule discussed for one category should not automatically be applied to another.
What if I have asylum, a removal order or immigration-court proceedings?
Those facts can change the analysis. Tell counsel about all proceedings, orders, arrests, prior departures and planned destinations, including any travel to a country connected to an asylum claim. Do not assume a travel approval resolves an order or a separate court obligation.
Can an urgent family situation be reviewed?
Ask about the current USCIS emergency-travel or expedite process. A request requires review of the particular circumstances and supporting evidence; urgency does not guarantee approval or eliminate travel risks. Contact the office directly for time-sensitive concerns.
