CBP One Parole Termination: Can a Prior USCIS Decision Be Reopened?

A past denial may deserve another look.

Certain Sileiri Doe class members may request review of qualifying adverse USCIS decisions without a USCIS filing fee. Eligibility matters. Reopening and approval are not automatic.

A filing-fee exception is not free legal representation.

A past denial may deserve another look.

What changed?

USCIS published guidance on October 26, 2026, implementing a September 28 court order in Sileiri Doe v. DHS. It describes a limited process for class members to ask USCIS to reopen or reconsider certain adverse benefit decisions affected by the April 2025 parole termination.

Reviewed October 27, 2026. Court orders, agency guidance and individual circumstances may change.

Who should ask about eligibility?

  • People who scheduled entry appointments through CBP One and were paroled between May 16, 2023, and January 19, 2025.
  • People who received an April 2025 mass parole-termination email and later received an adverse USCIS benefit decision.

These are screening clues, not a complete eligibility determination. The class definition, decision, connection to the termination and procedural history need individual review.

Does this apply to every parole recipient or immigration denial?

No. It is a specific class-based process. Having parole, a CBP One appointment or a denial alone does not establish eligibility.

Does the fee exception cover parole-based work-permit requests?

No. Requests for employment authorization based on parole are excluded from this identified fee-free process. Do not treat this announcement as an automatic work-permit renewal or restoration of work permission.

What if my case is already in immigration court?

Jurisdiction requires additional review. USCIS and immigration court have different authority. Counsel should review the court record and the current USCIS instructions before choosing a procedure.

Does asking USCIS to review a decision guarantee approval or stop removal?

No. A request is not an approval, automatic reopening or protection from removal. A benefit decision and a removal case can involve separate procedures. An inquiry to the firm does not extend deadlines.

Records to gather for a useful review

  • The parole-termination email and any later agency communications.
  • Entry and parole records, USCIS receipts and the complete adverse decision.
  • Immigration-court papers, existing orders and upcoming dates, if any.

Keep these records private. Ask the office how to provide them securely. Do not post notices, A-numbers or case history in public comments.
